In NO event shall iGhetto.com be liable, whether in Contract, Tort (Including Negligence) or otherwsie, for any indirect, incidental or consequential damages arising out of or pertaining to the subject matter of this agreement or the use of the site.

iGhetto.com provides its services ("iGhetto.com Services") to you, subject to your agreement to abide and be bound by these terms of service ("Terms of Service"). These Terms of Service set forth the terms, conditions, rules and regulations which shall apply to your use of the iGhetto.com Services. Unless explicitly stated otherwise, any new feature that supplements or enhances the current iGhetto.com Services, shall be subject to these Terms of Service. You acknowledge and agree that the iGhetto.com Services and any necessary software used in connection with the iGhetto.com Services ("Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that content contained in sponsor advertisements or information presented to you through the iGhetto.com Services or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. THE iGhetto.com SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. iGhetto.com EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
(ii) iGhetto.com MAKES NO WARRANTY THAT (a) THE iGhetto.com SERVICES WILL MEET YOUR REQUIREMENTS, (b) THE iGhetto.com SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (c) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE iGhetto.com SERVICES WILL BE ACCURATE OR RELIABLE, (d) THE QUALITY OF ANY SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE iGhetto.com SERVICES WILL MEET YOUR EXPECTATIONS, AND (e) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
(iii) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE iGhetto.com SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
(iv) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM iGhetto.com OR THROUGH OR FROM THE iGhetto.com SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF SERVICE.

LIMITATION OF LIABILITY .

YOU EXPRESSLY UNDERSTAND AND AGREE THAT iGhetto.com SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF iGhetto.com HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE iGhetto.com SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE iGhetto.com SERVICES; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE iGhetto.com SERVICES; OR (v) ANY OTHER MATTER RELATING TO THE iGhetto.com SERVICES.

EXCLUSIONS AND LIMITATIONS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTIONS P AND Q MAY NOT APPLY TO YOU.

COPYRIGHTS and COPYRIGHT AGENTS .

iGhetto.com respects the Intellectual Property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide iGhetto.com's the following information:
(i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
(ii) a description of the copyrighted work that you claim has been infringed;
(iii) a description of where the material that you claim is infringing is located on the site;
(iv) your address, telephone number, and e-mail address;
(v) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;

The Terms of Service constitute the entire agreement between you and iGhetto.com, governs your use of the iGhetto.com Services and supercedes any prior agreements between you and iGhetto.com. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. The Terms of Service and the relationship between you and iGhetto.com shall be governed by the laws of the State of New York without regard to its conflict of law provisions. You and iGhetto.com agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within the county of New York, New York. The failure of iGhetto.com to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. If any provision of the Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Service remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the iGhetto.com Services or the Terms of Service must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in the Terms of Service are for convenience only and have no legal or contractual effect.
